    At-Home Pickup Pilot Terms and Conditions

    1. Agreement to Terms and Conditions. These At -Home Pickup Terms and Conditions (the “Terms and Conditions”) apply to your use of Canada Post’s At-Home Pickup service. By clicking “I agree to the At-Home Pickup Terms and Conditions”, you confirm your acceptance of the Terms and Conditions and create a legally binding contract with Canada Post Corporation (“Canada Post” or “we” or “us”).

      These Terms and Conditions affect your legal rights and responsibilities. Without liming the forgoing, you assume full responsibility and liability for: (i) any failure to comply with the Terms and Conditions, and (ii) your use and /or attempted use of the At-Home Pickup service.

    2. At-Home Pickup Service Pilot & Duration. Canada Post is offering a new service called “At-Home Pickup” to eligible consumers. At-Home Pickup allows eligible consumers to have their eligible return packages picked up from the comfort of their own home.

      At-Home Pickup is being offered as a pilot program and is launching on July 17, 2023. While we expect to run this pilot program from July 17, 2023 to October 6, 2023, these dates may change without notice. We may terminate At-Home Pickup at anytime without notice.

    3. Eligibility Requirements. To be eligible for At-Home Pickup, you must satisfy each of the requirements set out below. You represent and warrant that each of these requirements are satisfied.

      1. Eligible Customers - Consumers Only. You are requesting At-Home Pickup as a consumer. Without limiting the foregoing, neither businesses, corporations, nor organizations are eligible for At-Home Pickup.

      2. Eligible Residential Dwelling & Location.

        1. Your home is a single-family residential dwelling that: (A) is detached, semi-detached, or attached in a row, and (B) has a separate entrance. At-Home Pickup is not available to residents living in multi-unit dwellings.

        2. Your home is located in Vancouver, British Columbia, Montréal Chabanel, Quebec, or Montréal Laval Ouest, Quebec, in a neighbourhood having a postal code that starts with the following 3 characters:

      3. Eligible Return Items.

        1. Canada Post Returns Only. You are only using At-Home Pickup to return items that were originally shipped to you by a merchant using Canada Post’s parcel services. You may only use At-Home Pickup if you are using a Canada Post parcel returns label that was provided to you by the merchant.

        2. Return Package Contents. Your return package must not contain any non-mailable matter (also referred to as “prohibited items”) or controlled items. Refer to our “Restrictions on personal shipping page and the Canada Postal Guide at canadapost.ca/postalguide under Non-mailable matter for details.

        3. Return Item Packaging & Returns Label. Your return item is securely packaged, and a Canada Post returns shipping label affixed to the package in accordance with Canada Post’s packaging and labeling requirements. Refer to the Canada Postal Guide at canadapost.ca/postalguide under ABCs of Mailing for details.

        4. Package Weight and Dimensions. The packaged return falls within the specifications set out below:

          *L = length; G = girth (girth is the distance around the item, measured at right angles to the length)

        5. Maximum Number of Packaged Returns per Pickup. You are requesting pickup for up to three (3) eligible packaged returns. Canada Post will not pick up more than three (3) eligible packaged return items.

      4. Availability at Home. Someone must be at your home and available from 9:00 a.m. to 5:00 p.m. on the scheduled pickup date to hand your return package to Canada Post’s delivery agent. The delivery agent will knock or ring the doorbell to receive the package and scan the return label. Unattended packages will not be picked up. Without limiting the foregoing, Canada Post will not pick up your return package if left in your mailbox, outside your door, or if the package is otherwise unattended.

    4. Requesting At-Home Pickup. To request At-Home Pickup, visit [canadapost.ca/athomepickup] and complete the online form. Without limiting the foregoing, you must provide your email address, preferred pickup date and alternate requested pickup date when completing the form.

      We will communicate with you via email to confirm your pickup details, provide status updates, provide the At-Home Pickup service, and as otherwise required by the Terms and Conditions.

      Your preferred and alternate requested pickup dates must be on Business Days and cannot overlap. A “Business Day” is a day other than the following: Saturday, Sunday, a statutory holiday, or any day observed as a holiday by Canada Post. At-Home Pickup is only available on Business Days. There is no guarantee that At-Home Pickup will occur on your preferred or alternate requested date. At-Home Pickup is not available for same-day pickups.

      We will respond to your request within one Business Day of the date your request is submitted. If your request is submitted on a day other than a Business Day or after Canada Post’s regular business hours, your request will be deemed to be made on the following Business Day.

    5. How to Reschedule or Cancel At-Home Pickup. To reschedule or cancel your confirmed At-Home Pickup, email us at at-home-pickup@canadapost.postescanada.ca between the following hours at least one (1) Business Day before your scheduled pickup date:

      Include in the email your full name, original scheduled pickup date, and whether you would like to reschedule or cancel your pickup. To reschedule your pickup, also include your requested alternate pickup date(s) in the email. There is no guarantee that At-Home Pickup will occur on your requested alternative pickup date(s).

      If we receive your email after the hours set out above or on a day other than a Business Day, your request will be deemed to be made on the following Business Day.

    6. Missed Pickup. If you miss your pickup, you will receive a follow-up email within one (1) Business Day of the missed pickup date asking if you would like to reschedule or cancel your pickup. If you fail to respond, your requested pickup will be cancelled. If you miss your pickup and do not receive a follow-up email, you may contact us at at-home-pickup@canadapost.postescanada.ca.

    7. Pickup not Guaranteed. Scheduled At-Home Pickup dates are not guaranteed. If your return package is not picked up on the scheduled pickup date, we will send you a follow-up email within one (1) Business Day of the missed pickup date to reschedule. If you do not receive this email, you may contact us at at-home-pickup@canadapost.postescanada.ca.

    8. Failure to Comply with Terms and Conditions. Canada Post, in its sole discretion, may reject any At-Home Pickup request and/or cancel any scheduled At-Home Pickup that does not comply with these Terms and Conditions. In addition, any packaged return that fails to comply with these Terms and Conditions may be rejected by the delivery agent, returned to sender, or otherwise not delivered.

    9. Fees. At-Home Pickup will be offered free of charge while it is offered as a pilot program. Canada Post shipping fees are charged separately, and are not included as part of the free At-Home Pickup service.

    10. Responsibility/Liability for Returned Items. You are responsible and liable for all your packages picked up by Canada Post. Without limiting anything contained in these Terms and Conditions, you agree not to request At-Home Pickup for any items that could be considered non-mailable matter (also referred to as “prohibited items”) or controlled items. Refer to our “Restrictions on personal shipping” page and the Canada Postal Guide at canadapost.ca/postalguide under Non-mailable matter for details.

    11. Disclaimers. We have taken considerable care to prepare and maintain Canada Post’s website (the “Site”). HOWEVER, WE ARE PROVIDING THE SITE AND ANY AT-HOME PICKUP SERVICE YOU REQUEST STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. Your use of the Site, request for At-Home Pickup, and/or use of the At-Home Pickup service is at your sole risk. Canada Post disclaims all warranties, expressed or implied, including implied warranties of accuracy, merchantability and fitness for a particular purpose.

      We may at any time without notice suspend or terminate operation of the Site and/or your access to the Site or any portion of the Site.

    12. EXCLUSION OF LIABILITY. NOTWITHSTANDING ANYTHING TO THE CONTRARY AND WITHOUT LIMITING ANY OTHER LIMITATIONS OF LIABILITY THAT APPLY TO CANADA POST’S PARCEL SERVICES AND/OR THE SITE, IN NO EVENT WILL CANADA POST, ANY AFFILIATE OF CANADA POST, AND/OR ANY EMPLOYEE, OFFICER, DIRECTOR, OR REPRESENTATIVE OF CANADA POST OR ANY AFFILIATE OF CANADA POST (EACH OF THE PREVIOUSLY MENTIONED PARTIES, INDIVIDUALLY AND COLLECTIVELY, BEING THE “CANADA POST PARTIES”) BE LIABLE FOR ANY LOSS OR DAMAGES WHATSOEVER ARISING OUT OF, OR OTHERWISE RELATED TO: (i) YOUR USE AND/OR ATTEMPTED USE OF THE AT-HOME PICKUP SERVICE, (ii) THESE TERMS AND CONDITIONS, OR (iii) CANADA POST’S DELIVERY, ATTEMPTED DELIVERY, OR FAILURE TO DELIVER ANY PARCEL. THIS EXCLUSION OF LIABILITY APPLIES NO MATTER WHAT KIND OF LOSS OR DAMAGE YOU EXPERIENCE, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, GENERAL, SPECIAL, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, OR OTHER DAMAGES.

      THIS EXCLUSION OF LIABILITY APPLIES:

      (1) WHETHER THE ACTION IS IN CONTRACT, TORT OR OTHERWISE;
      (2) EVEN IF CANADA POST IS EXPRESSLY ADVISED OF THE POSSIBILITY OF LOSS OR DAMAGES; AND
      (3) NO MATTER WHAT CAUSED THE LOSS OR DAMAGES, INCLUDING WITHOUT LIMITATION CANADA POST’S NEGLIGENCE AND/OR GROSS NEGLIGENCE.

      THIS EXCLUSION OF LIABILITY APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW.

    13. Indemnity. You will indemnify the Canada Post Parties against all claims, demands, damages, losses, fines, expenses (including all legal fees and costs) and/or any other types of liability (individually and collectively, the “Claims”) to the extent the Claim is caused by: (i) your breach of the Terms and Conditions, and/or (2) your use and/or attempted use of the At-Home Pickup service. We may, in our sole discretion, assume the exclusive defence and control of any Claim otherwise subject to this indemnification by you. Even if we assume the defence of a Claim you will remain responsible for the payment of the Claim, and you will cooperate as fully as reasonably required by us in the defence of any Claim.

    14. Other Terms and Conditions. These Terms and Conditions and your use of Canada Post’s At-Home Pickup service are also subject to the following:

      1. The Canada Postal Guide; and
      2. The Canada Post Terms of Use.

      Your use of the Site is subject to the Canada Post Terms of Use. Your use of Canada Post’s parcel services is subject to the Canada Postal Guide.

    15. Canada Post Corporation Act. Notwithstanding anything else in these Terms and Conditions or any other document, your use of Canada Post’s At-Home Pickup service and Canada Post’s parcel services is subject to the provisions of the Canada Post Corporation Act and its Regulations (the “Act”). To the extent there is any conflict between the Act and anything else, the Act will govern.

    16. Amendments. We may change these Terms and Conditions at any time without notice. It is your responsibility to check this website regularly for changes. Your continued use of the At-Home Pickup service following the posting of changes to these Terms and Conditions will mean that you accept and agree to the changes. Without limiting the foregoing, we may change or terminate the At-Home Pickup service at anytime without notice.

    17. Governing Law & Jurisdiction. These Terms and Conditions and all disputes or other matters arising out of the use and/or attempted use of the At-Home Pickup service will be governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict of law principles. Any dispute will be dealt with solely by a court of competent jurisdiction in Canada.

    18. Entire Agreement. The Terms and Conditions state the entire agreement and supersede all prior agreements or understandings, whether written or oral, with respect to its subject matter.

    19. Severability. If any provision or any part of any provision of the Terms and Conditions is held to be unenforceable, invalid, or illegal, then it shall be severable and deemed to be deleted and the remaining provisions shall remain valid and binding.

    20. Survival. The terms of these Terms and Conditions that by their nature are intended to survive the termination or expiration of these Terms and Conditions (including without limitation, Section 11 (Disclaimers), Section 12 (Exclusion of Liability), and Section 13 (Indemnity)) shall survive.

    21. Assignment. You may not assign these Terms and Conditions, nor any of your rights or obligations under these Terms and Conditions, in whole or in part, at any time.

    22. Headings/Interpretation. Headings in the Terms and Conditions are included for convenience only, and not for purposes of interpretation. The words in the Terms and Conditions shall be interpreted simply according to their fair and plain meanings, and not strictly for or against either party, regardless of which party drafted the Terms and Conditions or any specific provision.

    23. No Waiver. Failure of a party to insist on strict adherence to any term or provision of the Terms and Conditions on any occasion or the waiver of a breach of the Terms and Conditions in any instance will not deprive the party of the right thereafter to insist on strict adherence to that term or provision or any other term or provision in the Terms and Conditions or be construed as a waiver of any subsequent breach, whether or not similar.
